Where is Your Original Will?
Original wills should be kept in a safe place at all times. But, of course, sometimes originals go missing. When the original will can’t be found and a copy is available, it may be possible to obtain a grant of probate using the copy, but there are hurdles that you have to jump. A court order is required and the court has to be satisfied of a number of things including;
a. That the original will has not been deliberately destroyed;
b.That the will revoked all prior wills;
c.That the will was properly executed and was intended to be the last will of the deceased.
An application for probate based on a copy is not uncommon, but best to be avoided if possible.
